Fair Usage Policy

1. Introduction and Purpose
This Fair Usage Policy (FUP) forms part of the Master Services Agreement between you ("Customer") and Mokkup.ai ("Company") and governs your use of the Mokkup.ai Enterprise Plan ("Services").
We offer "Unlimited AI Coins" and "Unlimited BI Exports" in good faith to provide you with predictable costs and the freedom to create. This policy exists to ensure that the Services remain stable, fast, and available for all our Enterprise customers. It prevents abusive or fraudulent use of our multi-tenant (shared) platform.
2. Applicability
This FUP applies to all Services included in the Enterprise Plan, specifically those marketed as "unlimited," including but not limited to:
- AI-powered dashboard generation ("Create with AI")
- AI-powered wireframe analysis ("Review Wireframe")
- Conversational AI chatbot features
- BI tool exports (e.g., to Power BI, Tableau)
3. Prohibited Uses
You and your authorized users may not use the Services in any manner that:
A. Is Illegal or Harmful
For any purpose that is fraudulent, illegal, defamatory, harassing, or that infringes on the rights of a third party.
B. Is Automated or Non-Human
To conduct any automated, bot-like, or scripted activity that is not a normal, human-driven part of the design or wireframing process (e.g., high-frequency, systematic API calls, web scraping, or running 24/7 automated generation scripts).
C. Is for Resale or Competition
- To resell, sublicense, or otherwise provide the AI features or BI exports as a monetized, standalone service to third parties.
- To reverse-engineer the Services or use their output (including AI-generated content) to create, train, or improve a competing artificial intelligence model or service.
D. Degrades Platform Stability
Engages in any activity that imposes an unreasonable or disproportionate load on our infrastructure, or otherwise degrades the Service stability, speed, or performance for other users. Our monitoring for this is based on platform performance, not on a comparison of your usage to other users.
4. Our Enforcement Approach
We monitor for usage patterns that violate this policy, with a focus on platform health. If your account is flagged for a potential violation, we will almost always follow this process:
A. Investigation and Communication
Our primary goal is to be your partner. In all non-urgent cases, our first step will be to contact your account administrator to understand your use case. Legitimate, high-volume work (like a large-scale migration or a team-wide workshop) is welcome.
B. Service Throttling
If a use case is determined to be in violation and is actively harming platform stability for other users, we reserve the right to apply rate limits or throttle access to the specific features to maintain service quality. We will make a reasonable effort to provide notice before doing so.
C. Suspension or Termination
Continued, willful, or severe violations of this FUP, after we have attempted to contact you, may result in the suspension or termination of your account's access to the Services, as defined in our Master Services Agreement.
5. Extenuating Circumstances
We understand that legitimate business needs can sometimes lead to very high usage (e.g., a major project deadline, a company-wide ideation workshop).
If you anticipate a high-volume event, please contact your account manager or our support team in advance. We are happy to work with you to ensure our platform is prepared and your team has a seamless experience.
6. Policy Updates
Mokkup.ai reserves the right to update this Fair Usage Policy at any time. Any significant changes will be communicated to your account administrator.
